These Terms of Service ("Terms") govern your access to and use of the MarketMyBusiness platform, website, and applications (the "Platform"), operated by TactInk Solutions Private Limited ("TactInk", "we", "us"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
You must be at least 18 years old and capable of forming a binding contract under Indian law. By using the Platform, you represent that you use it for a legitimate business and that the information you provide is accurate and current.
You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately of any unauthorised use. You are responsible for the conduct of any team members you invite to your account.
You agree not to use the Platform to:
You are solely responsible for obtaining the consent required to contact your customers and for complying with the policies of WhatsApp, Meta, email providers, and all applicable communication and data-protection laws.
The Platform is a tool that sends messages at your instruction. We are not responsible for the content of messages you create or the consequences of sending them. We may suspend messaging features if we reasonably believe they are being used in violation of these Terms or third-party policies.
The Platform integrates with third-party services such as WhatsApp Business, Meta, email gateways, and Google Business. Your use of those services is governed by their own terms. We are not responsible for the availability or actions of third-party services.
The Platform, including its software, design, and content (excluding your data and content), is owned by TactInk and protected by law. You retain ownership of the data and content you upload. You grant us a limited licence to process it solely to provide the Platform.
The Platform uses AI to generate campaigns, messages, and recommendations. AI output may be inaccurate or inappropriate. You are responsible for reviewing all content before sending or publishing it.
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or that it will achieve any particular marketing result.
To the maximum extent permitted by law, TactInk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue. Our total liability for any claim arising from these Terms or the Platform shall not exceed the amount you paid us in the three months preceding the claim.
You may stop using the Platform and cancel your account at any time. We may suspend or terminate your access if you breach these Terms or use the Platform in a way that harms us, other users, or third parties.
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka.
We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. Continued use after changes take effect constitutes acceptance.
